Sales Policies and Ordering Information

Early Ordering and Shipping

Orders for test materials should be placed at least six weeks before the testing dates. This allows adequate time for shipping, checking materials upon receipt, and providing in-service prior to testing. Please allow at least 21 calendar days from the date of your order for receipt of materials. Shipping charges vary according to weight, destination, and value of the order. Materials are shipped by UPS or motor freight, whichever is the more economical method. If a specific method of shipment is preferred, please authorize such a shipment on the purchase order. Shipping and handling is added to the invoice (estimate $10.00 for orders under $100.00 and 10% of the cost for orders over $100.00. For International orders, estimate 25%).

Rush orders with short timelines will be shipped by the most efficient means needed to meet the date requested. Premium cost transportation, if needed, should be authorized by, and will be charged to, the purchaser, in addition to the normal handling charge. Cash and credit card rush orders require a shipping and handling fee of an estimated 10% ($10.00 minimum; 20% for air express shipments, 25% for International shipments) of the total price of materials purchased.

The delivery address should be checked for accuracy. Information about restricted delivery, including the hours of days during which shipments can be delivered, must be provided. Reshipments of undeliverable orders will be charged to the purchaser.

All shipments should be checked as soon as they are received.

Discrepancies in shipments must be reported within 60 days of the date of invoice to obtain any credit or adjustment. When reporting discrepancies, please include name of purchaser, shipping address, billing address (if different from shipping address), purchase order number and date, and a description of the order. Invoice number and date of invoice should also be provided when available.

To inquire about a scoring order, please be ready with the order number printed in the information box on the score report.

Terms are net 30 days. Cash discounts are not available.

Note: All payments must be in U.S. funds. For International orders, all pre-paid or credit card orders should include a shipping charge of 25% of the total price of all materials purchased. All invoiced orders will include actual shipping costs and a handling charge.

Invoices for services and shipping and handling charges are normally mailed two to three weeks after the score reports are sent to your school. If more rapid billing is required at the end of the budget year, please call Customer Service with your purchase order and information about your order — date shipped, grades, services, etc. — and indicate when the billing must be made. Every effort will be made to meet your billing request. However, Riverside Publishing is not responsible for meeting billing requests made on short notice.

Return Policy

Materials will be authorized for return for credit provided that the materials are a current edition and were invoiced within the prior eighteen months, and the materials are in unused and undamaged salable condition. Packages of materials, kits, or software must be unopened. Call or write Riverside's Customer Service Department to request an authorization for the return. Unauthorized returns are subject to restocking fees or may be refused or returned to the customer. Shipping charges for returning materials are the responsibility of the purchaser.

Scoring service reports, including magnetic tapes and disks, are not returnable for credit.

Price, Terms and Conditions of Sale

The sale of Riverside test materials and services is based upon acceptance of the prices, terms, and conditions described here. A purchaser accepts these prices, terms, and conditions by signing an order form or purchase order, or by making a full or partial payment of an invoice. Riverside Publishing is not bound to any modification or addition to the prices, terms, or conditions of sale unless agreed to in writing by an officer of the company.

Prices

The prices on this site are effective January 1, 2006, and are subject to change without notice. All materials are shipped F.O.B. shipping point.

Conditions of Sale

The following test security policy statement appears on all of Riverside Publishing's invoices and packing slips:

These tests contain questions that are to be used solely for testing purposes. No test items may be disclosed or used for any other reason. By accepting delivery of or using these tests, the recipient acknowledges its responsibility for maintaining test security that is required by professional standards and applicable state and local policies and regulations governing proper use of tests, and for complying with federal copyright law which prohibits unauthorized reproduction and use of copyrighted test materials.

Warranties

Riverside Publishing warrants that each test offered for purchase is suitable for its intended use, meets educational and professional standards, and is manufactured in usable quality. UNLESS EXPRESSLY AGREED TO IN WRITING BY AN OFFICER OF THE COMPANY, THE COMPANY MAKES NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

The purchaser and/or user assumes all responsibility for use or misuse of the tests. RETURN, REPLACEMENT, OR REFUND OF ALL OR PART OF THE PURCHASE PRICE, BASED UPON USABILITY OF THE TEST MATERIALS AND SERVICES, IS THE COMPANY'S SOLE OPTION, AND CONSTITUTES THE SOLE AND EXCLUSIVE REMEDY OF PURCHASER, IN LIEU OF ACTUAL, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR OTHER DAMAGES IN CONNECTION WITH A TEST, TEST MATERIALS, SCORING, OR OTHER SERVICES, AND ANY USE OR MISUSE OF SAME. Riverside will not, under any circumstances, be liable for the purchaser's and/or user's expenses in using a test; for delays; for costs of substitute materials and shipping; or for possible lost income, grants, profits, or any other damages.

Copyright Restrictions

All of Riverside Publishing's publications and many specialized forms and services are copyrighted. The purchaser and/or user acknowledges and agrees when ordering that the contents of the company's tests, including proprietary and confidential material, property, procedures, and information owned by Riverside and/or its authors, constitute what is legally termed trade secrets.

The tests and ancillary test materials, including answer documents, score reports, disks, and norms tables, are copyrighted. As such, they may not be reproduced, replicated, or transmitted, for any purpose, in whole or in part, in any form or by any means, electronic or mechanical, or be stored in a database or retrieval system or made accessible through the Internet or other network, without prior written permission by an authorized employee of the company.

To produce scoring service reports, Riverside Publishing uses copyrighted tables. The provision of the data from these tables does not give or imply permission to replicate norms data listed on the reports or to derive or extract data from the norms or other copyrighted tables. Such replication without prior written permission from an officer of the company is a violation of copyright laws.

Permissions and Licensing

Riverside Publishing requires a license of all users of norms tables, including users in nonprofit institutions. Test norms are an integral part of the test. Copying test norms without authorization is a violation of copyright.

Requests for permission to reproduce, translate, or modify all or any part of Riverside Publishing's copyrighted materials, including out-of-print titles, should be forwarded to the Riverside Publishing Contracts and Permissions Department prior to the time any work has begun. The requests should include information about the nature and purpose of the research study, thesis, report, or publication for which the reproduction is needed. The exact description of what is to be reproduced, how the reproduction is to be made, and information about the distribution and/or sales of the publication in which the reproduction will appear must be provided.

Answer documents—answer sheets, answer folders, and answer booklets—are an integral part of the tests and are protected by copyright laws. All users, including school personnel, who wish to reproduce, modify, or adapt answer documents in any manner, including overprinting of generalized documents, are required to obtain licenses. Procedures for royalty payment, based on number of answer sheets reproduced, are included in the licensing arrangement. Write to the Riverside Contracts and Permissions Department for additional information.

Software Licenses

No site licenses are available for clinical software products. You may only install Riverside Publishing clinical software products onto a single computer for use solely with that computer. If you need to use multiple computers, you must purchase a separate copy of the software for each computer from Riverside Publishing. Riverside offers a quantity discount on all orders of 5 or more software products.

Qualifications for Ordering Tests

Riverside Publishing requires all first-time individual test purchasers to furnish evidence of their qualifications to use tests. Riverside reserves the right to require evidence of qualification on any or all subsequent purchases. Test use should be consistent with sound professional practice, particularly those principles outlined in the 1985 publication, Standards for Educational and Psychological Testing. This publication was developed by members of the American Psychological Association (APA), American Educational Research Association (AERA), and the National Council on Measurement in Education (NCME). Tests and their related materials are to be released only to persons with the knowledge and skills needed for effective test administration and test interpretation.

Riverside Publishing reserves the right to accept, reject, or withdraw whole or part orders for materials when the recommended standards are not met. Riverside may also reject orders that conflict with local school district or state department of education policies that restrict the distribution of test materials.

The following conditions and procedures for ordering must be met by accredited educational institutions and qualified private agencies and individuals to obtain test materials:

Educational Institutions
Accredited schools and colleges must submit orders on an official purchase order form or the school's official stationery. The order must be signed by a school administrator. Initial orders from private schools must be submitted with the Test Purchaser Qualification Form (Adobe® Acrobat® PDF, 22 K).

Teachers
Teachers must submit their orders on the school's stationery, accompanied by a purchase order if required by the school. The order must be counter-signed by the school principal or by another authorized administrator.

Hospitals, Rehabilitation Centers, and Private Practices
Accredited hospitals, rehabilitation centers, and other medical facilities must submit orders on an official purchase-order form or the institution's official stationery. The order must be signed by an administrator. Initial orders from private practice groups must be submitted with the Test Purchaser Qualification Form.

University Students
Graduate and undergraduate students and researchers may order test materials for research purposes. Their orders must be countersigned by the professor heading the research study or by another qualified administrator who is willing to accept responsibility for guaranteeing security and proper use of materials and services.

University Libraries
University libraries must submit their orders with a signed statement agreeing to the following conditions: (1) Materials will be kept in locked files, and (2) Materials will only be released to students or personnel who need them to meet course or research requirements upon approval of the appropriate faculty member. This statement must be signed by the librarian or professor responsible for the materials. A brief outline of the intended use and nature of research should also accompany the statement.

Individuals, Non-Educational Institutions, and Home Schools
Individuals in private practice, and business and government agency staff members who have not previously ordered Riverside Publishing text materials must submit a statement of purchase eligibility with their orders. The Test Purchaser Qualification Form (Adobe® Acrobat® PDF, 22 K), or a letter outlining all the information requested on the Test Purchaser Qualification Form, must be used for this purpose. The form may be photocopied. Additional verification of qualifications may be required. Home schools and tutoring agencies must arrange for testing with a school or agency approved by the publisher.

University Training Program

Riverside Publishing supports and encourages the use of the Gates-MacGinitie Reading Tests, Fourth Edition and its individually administered clinical assessments in college and university courses for training professionals. Faculty who teach these courses appreciate the need for test security and the ethical and professional standards for valid use of such tests.

College or university faculty using individually administered tests published by Riverside Publishing may qualify for a special 40% discount on complete/basic test kits or record forms. This discount does not apply to group-administered tests such as the Iowa Test of Basic Skills®, to tests which Riverside distributes but does not publish, or to university libraries ordering tests for uses other than training students in a specific course.

30 Day Preview

Riverside Publishing offers a 30-day preview on selected kits. An invoice for the kit will be generated at the time of shipment. If the material is returned within this 30-day period, then a credit will be applied to the invoice, less a shipping and handling charge. All shipping and handling charges are the responsibility of the customer.

Restricted Tests

Some tests published by Riverside Publishing, including but not limited to the Stanford Binet Intelligence Scale, the Woodcock-Johnson® III, the Das•Naglieri Cognitive Assessment System, and the Universal Nonverbal Intelligence Test must be administered by a trained, certified examiner. Purchase of these tests is therefore restricted to qualified examiners. All new orders for these tests must be submitted with the Test Purchaser Qualification Form (Adobe® Acrobat® PDF, 22 K), completed and signed by the test examiner.

Prohibition Against Sale, Distribution, and Reproduction

No testing materials or services may be sold, distributed, or reproduced in whole or in part without written permission from the publisher.

Shipping Answer Documents for Scoring

Caution! When planning your testing program, be sure to schedule enough time between test administration and posttest use of results for Riverside Scoring Service® to process answer documents. Once your shipment arrives at the Riverside Scoring Service, it may take up to three weeks to process the results during the busy fall and spring testing periods. If answer documents are not in machine-processable condition when they arrive at the Riverside Scoring Service, results will be delayed while the documents are put into a processable form.

Shipments should be prepaid and the method of shipment should be determined by your posttesting schedule. Shipment by UPS is recommended. First class mail should only be used if UPS is not available in your area. Results are returned via 2-day air method, unless otherwise specified.

All answer documents for The Iowa Tests, Form A and B and Cognitive Abilities Tests, Form 6, Logramos, and Iowa Early Learning Inventory are to be sent to:

How to Avoid Processing Delays for Scoring Services

Typical processing time for most scoring is 10-15 working days. Processing time for Performance Assessments and the Constructed-Response Supplement is about 6-8 weeks. To avoid delays, please check the OSS and other forms carefully. Common causes of delay are listed below, with the typical delay time in parentheses.

  • OSS is not included with the shipment (7-14 days).
  • Cartons are not properly numbered in sequential order.
  • Incomplete shipments or answer documents that do not match the numbers listed by grade by building on the OSS (7-14 days; up to 20 days if local norms are ordered).
  • Testing date is not given (2-5 days).
  • Plans, services, and scores needed are not marked (2-10 days).
  • ID sheets are not inserted or completed properly, or photocopies of ID sheets are used (7-21 days).
  • Norms wanted are not marked (2-5 days).
  • Software platform is not marked on data services (2-5 days).
  • Special Instructions box is marked, but no special instructions are attached (3-10 days).
  • Special program identification sheets are not attached to the OSS (7-14 days).
  • Pre-Post Service forms are not attached to the OSS (7-14 days).
  • Transmittal/format sheets are not enclosed with premium service and bar code shipments (3-10 days).
  • "Send To" address is incomplete (1-7 days).
  • Answer documents are sent to an address other than the Iowa City address (7-21 days).
  • Level or form of test taken is not gridded on documents (2-5 days).

Note: if any of the above information is missing or information is not received within a reasonable period of time, Riverside Publishing reserves the right to resolve the situation using rules of thumb based on past experiences.

Purchase Orders

If your school or district requires a purchase order, make certain your purchase order number is written on the OSS. However, do not send the purchase order with the Order for Scoring Services and answer documents. The purchase order cannot be used as a substitute for an OSS.

Confidentiality of Reports

The distribution of reports to the appropriate persons and the maintenance of report confidentiality are the responsibility of the scoring service purchaser and/or user. The facilities used by the Riverside Scoring Service meet stringent government security regulations. The Riverside Scoring Service will not send reports to anyone inside or outside the school district without written authorization from the person whom original results were sent or whoever signed the Order for Scoring Services.

Late Service Requests

Requests for additional service(s) after reports are processed will be honored for up to 12 months from the date of original scoring. To obtain additional services after you have already received your reports, you must call with requests to Customer Service (800.323.9540).

Minimum Charges

The minimum charge for processing scoring service orders is $150.00 per Order for Scoring Services.

Minimum charges are also applied to some specific scoring services, i.e., subpopulates/system use reports
